De-Identified Data Use Agreement ("Agreement")
 
I request access to de-identified data collected by the National Institute on Aging from participants enrolled in The Baltimore Longitudinal Study on Aging ("Data") for internal, non-commercial research purposes only and agree to the following terms:
 
  1. The Data is the property of the National Institute on Aging ("NIA") and is made available as a service to the research community.
  2. The Data will not be used for any diagnostic, prognostic, or treatment purposed in human subjects.
  3. The Data will be used solely for the internal, non-commercial research purposes outlined in this agreement and my data use application.
  4. I will require anyone on my team who utilizes the Data, or anyone with whom I share the Data to comply with this Agreement.
  5. The Data will not be further distributed to any third party and I agree that appropriate safeguards are in place to prevent unauthorized use of or access to the Data.
  6. Upon request, I will provide information for persons who will use the Data and the analyses that are planned using the Data. I will respond promptly and accurately to annual requests to update this information.
  7. In all presentations, abstracts, and manuscripts concerning my research using the Data, I agree to acknowledge the contribution of the NIA as follows:

    "This [publication or presentation, as applicable] uses research data from The Baltimore Longitudinal Study of Aging study (BLSA) that has been made available through the LONI IDA and GAAIN. The BLSA is supported by the Intramural Research Program (IRP) of the National Institute on Aging (NIA). The authors thank the investigators, staff, and participants of the BLSA study and the neuroimaging sub-study for making the data available. BLSA investigators have not contributed to nor approved, and are not in any way responsible for, the contents of this [publication or presentation, as applicable]."

  8. I agree to use, handle, and dispose of the Data in compliance with all applicable laws, regulations, and policies and understand that the Data may be protected by the Privacy Act of 1974 (5 U.S.C. 552a) and/or a Certificate of Confidentiality (42 U.S.C. 241(d)).
  9. The Data has been collected from human subjects in accordance with applicable laws, regulations, and policies regarding the protection of human subjects. Personally identifiable information will not be provided.
  10. I will not contact or make any effort to identify individuals who are, or may be, the sources of Data. I agree to comply with all applicable laws, regulations, and policy requirements to protect the identity and privacy of human subjects from whom the Data was collected.
  11. I will report any use or disclosure of the Data not provided for by this Agreement of which I become aware within 15 days of becoming aware of such use or disclosure.
  12. The Data transferred under this Agreement is provided "as is." THE NIA MAKES NO REPRESENTATIONS AND EXTENDS NO WARRANTIES OF ANY KIND, EITHER EXPRESSED OR IMPLIED. THERE ARE NO EXPRESS OR IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, OR THAT THE USE OF THE DATA WILL NOT INFRINGE ANY PATENT, COPYRIGHT, TRADEMARK, OR OTHER PROPRIETARY RIGHTS. Unless prohibited by law, I assume all liability for claims for damages against me by third parties which may arise from my use, storage or disposal of the Data.
  13. I understand that The Baltimore Longitudinal Study on Aging in ongoing and that data analysis for this project and methods for analysis of these datasets may evolve. I understand that the processed datasets that I download may change as new methods of analysis are implemented. I will familiarize myself with the analysis methods so that I am aware of the limitations of the datasets prior to using them for research purposes. I will note the version of the Data that I download and will check LONI IDA and GAAIN to determine if updated Data has been provided prior to submission of any material for publication.
  14. I understand that failure to abide by these terms and obligations will result in termination of my privileges to access the Data.
